Man the Democrats in the confirmation hearing are being obnoxious. Roberts starts addressing a really good issue where he basically addresses a fundemental disagreement with what Scalia said about the due process clause in the paper I linked to. Biden interrupts him and says "that's not what I ask" and tried to get him to try a case about...

For those interested in the Supreme Court and the debate behind the debate, a good text on the matter can be found in Justice Scalia's lecture: Common-Law in aCivil-Law System: The Role United Federal Courts in Interpreting the Constitution and Laws. He makes some excellent and very rational arguments until the end. At the end he uses some...

One thing, from watching (really passively because I was writing code and listening in the background) the Roberts confirmation hearing, that stuck out at me was his repitition of stare decisis which is a principle of common law in which precedent makes law. Most of the far right originalists and strict constructionists while obviously not...

Is it just me or has the performance of the senate in the Roberts confirmation been rather poor. I especially found Dianne Feinstein to be obnoxious and a bit of a pedant. Personally I think Roberts was qualified to be on the court but I really don't feel he is qualified to be Chief Justice. He's already answered that he actually understands...

Check .NET's LINQ out. It adds some rather simple SQL-like operations directly to C# (and friends, but they bore me). Its mostly syntax candy, but its really tasty syntax candy that will simplify and clarify code. And what do we get? Groovy...bah. Note: Skip the boring marketing bla bla with the inevitable pictures of happy multiethnic yet...

Speaking of Steve Jobs, I once heard him quoted as saying that our industry was stagnant and was anything but innovative. I don't know if he said this, but I agree completely. Our industry is hopelessly freaking boring. Is anyone else bored? Java is the new COBOL. Ruby is the new PERL (frankly, boring, get off it). Struts, Rails, etc etc...

I've given a few launch demos in my day. And it is true Steve Jobs is the master. More and more I've tried to incorporate his style into my presentations (not just knock off but "embrace and extend"). Next time I give one of these demos, I'm going to call up Madonna too. "ring....ring...." -- "humm...guess she's not answering."
