ASCAP has been slapped down on one of their more absurd claims - that a ringtone constitutes a public performance (and thus requires a royalty payment). They still insist that 30 second "try before you buy" samples are public performances, which is equally stupid - how do I know whether I'll like a song from an artist that's been recommended to me if I can't play a short sample?
